Distance Selling Agreement

PASSLY – DISTANCE SELLING AGREEMENT

This Agreement is concluded electronically between the parties whose information is provided below.

ARTICLE 1 – PARTIES

(Hereinafter referred to as "BUYER".)

ARTICLE 2 – SUBJECT OF THE AGREEMENT

This agreement regulates the rights and obligations of the parties regarding the sale and delivery of Passly Card (NFC digital business card) products and services ordered by the BUYER electronically via www.passly.me.

The parties accept that they know their obligations within the scope of the Law on Protection of Consumers No. 6502 and the Distance Contracts Regulation.

ARTICLE 3 – GENERAL PROVISIONS

3.1. The BUYER declares that they have read and accepted all characteristics, price, payment, and delivery conditions of the purchased product in advance.

3.2. The product is delivered to the BUYER within 30 days at the latest after payment confirmation.

3.3. Delivery costs belong to the BUYER unless otherwise specified.

3.4. If the product is to be delivered to a person other than the BUYER, the SELLER is not responsible for the non-receipt.

3.5. The SELLER cannot be held responsible for delays caused by cargo.

3.6. The BUYER is obliged to check the product before receiving it. Damaged products must not be received.

3.7. In case of price or system errors, the SELLER has the right to cancel the order.

3.8. If the product cannot be supplied, the SELLER informs the BUYER within 3 days and refunds the payment.

3.9. In case of force majeure (weather conditions, transportation, etc.), the delivery time may be extended.

ARTICLE 4 – RIGHT OF WITHDRAWAL

The BUYER has the right of withdrawal within 14 days from the date they receive the product.

For right of withdrawal notification:

Return conditions:

  • The product must be unused
  • The original packaging must be undamaged
  • Must be sent with the invoice

The payment is made within 10 days after the return process is approved.

ARTICLE 5 – CASES WHERE THE RIGHT OF WITHDRAWAL CANNOT BE USED

Returns are not accepted in the following cases:

  • Customized products produced specifically for individuals
  • Products not suitable for return due to hygiene
  • Digital content and services delivered instantly
  • Used or damaged products

ARTICLE 6 – RESOLUTION OF DISPUTES

In case of dispute, the BUYER;

  • Consumer Arbitration Committee
  • Consumer Courts

can apply to.

ARTICLE 7 – DEFAULT

If the BUYER fails to fulfill their payment obligation, the relevant bank agreement will be valid and all responsibility that may arise belongs to the BUYER.

ARTICLE 8 – EVIDENCE AGREEMENT

The parties accept that electronic records are in the nature of evidence.

ARTICLE 9 – EFFECTIVENESS

This agreement becomes effective at the moment it is approved by the BUYER electronically.
